LesbianCash Terms of Service

These Terms are an agreement between you and SBA Creative Concepts, a California company, d/b/a LesbianCash ("LesbianCash," "we," "us," "our"). LesbianCash operates LesbianCash.com, SheSeducedMe.com and LesbianSexuality.com (the "Sites").

The Terms are in three parts:

• Part 1 applies to everyone who uses the Sites.
• Part 2 also applies to paying members.
• Part 3 also applies to affiliates in the LesbianCash program.

By using a Site, joining as a member, or signing up as an affiliate, you agree to these Terms. If you do not agree, do not use the Sites.

Part 1: Everyone

1. Adults only

The Sites contain sexually explicit material for adults only. You must be at least 18, or the age of majority where you live if that is higher, to enter. By entering, you confirm that you are of that age and that viewing adult material is legal where you are.

Where the law requires it, we verify age when you sign up or join, using a third-party age-verification provider, and we may block access to the Sites from certain locations. You may not use a VPN, proxy or false information to get around an age check or location restriction. Do not let minors use your device or account to view the Sites. Parental-control tools can help keep minors away from adult material.

2. What the Sites are

The Sites offer adult videos and photos produced by us. Everyone who appears in our content was 18 or older when it was recorded and consented to being recorded and published (see Section 9 for age records).

Reporting illegal content. We do not allow child sexual abuse material, non-consensual content, or any other illegal content. If you see anything on a Site that you believe is illegal or was published without a person's consent, report it to sheseducedmexxx@gmail.com. Include the page address and why you are reporting it. We review every report and respond within 7 business days, and we remove illegal content promptly. We report suspected child sexual abuse material to the National Center for Missing & Exploited Children (NCMEC) and cooperate with law enforcement. To report material on other websites, use the NCMEC CyberTipline (https://report.cybertip.org) or ASACP (https://www.asacp.org).

Performer removal requests. Anyone who appears in our content, or that person's authorized representative, may ask us to remove it by writing to sheseducedmexxx@gmail.com. We will review the request, including the consent records for that content, and respond within 7 business days. If valid consent cannot be confirmed, or the person shows that their consent is no longer valid under applicable law, we will remove the content. If we disagree that consent is invalid, we will refer the disagreement to a neutral third party for resolution, at our expense.

3. License

We give you a limited, personal, non-exclusive, non-transferable license to view the Sites for your own private, non-commercial use, on devices you own or control. The license ends if you break these Terms. You do not acquire ownership of any content.

4. Acceptable use

You may not:

• copy, download (except where a Site offers downloads to members), record, redistribute, sell, rent, publicly display or re-upload any content;
• remove copyright or other notices;
• frame the Sites or copy their look and feel;
• scrape, crawl or monitor the Sites with bots, or reverse-engineer them;
• interfere with the Sites' security or operation, or upload malware;
• share your login or let anyone else use your account;
• use the Sites for anything illegal.

We may suspend or end access for anyone who breaks these rules.

5. Changes

We may update these Terms. When we do, we will post the new version with a new "Updated" date. If a change is material, we will tell members and affiliates by email or on the Sites at least 15 days before it takes effect. If you keep using the Sites after a change takes effect, you accept the new Terms. Changes do not apply to disputes that arose before they took effect.

6. Privacy

Our Privacy Policy, at https://lesbiancash.com/external.php?page=privacy, explains how we collect, use and protect personal information. It is part of these Terms. Payment card details are collected and held by our payment processors (Epoch and SegPay), not by us. We do not sell member lists or share personal information for targeted advertising. The one exception is the additional-membership offer at checkout (Section 21); the Privacy Policy explains this and how to opt out.

7. Copyright

All content on the Sites, including videos, photos, text, graphics, logos and the selection and arrangement of that content, is owned by or licensed to SBA Creative Concepts and is protected by US and international copyright law. Unauthorized use may lead to civil and criminal liability.

8. Copyright complaints

We follow the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe content on a Site infringes your copyright, send a notice to our designated agent with:

• your physical or electronic signature;
• the copyrighted work you claim is infringed;
• the location (URL) of the material on the Site;
• your address, telephone number and email;
• a statement that you believe in good faith that the use is not authorized by the copyright owner, its agent or the law; and
• a statement, under penalty of perjury, that your notice is accurate and that you are the copyright owner or authorized to act for the owner.

If your material was removed and you believe that was a mistake, you may send a counter-notice that meets 17 U.S.C. § 512(g)(3). In appropriate cases we end the accounts of repeat infringers. Please send only copyright notices to the agent. All other complaints go to the email address in Section 2.

9. Records (18 U.S.C. § 2257)

Everyone appearing in any visual depiction of actual or simulated sexually explicit conduct on the Sites was at least 18 years old when it was created. The producer of the content is SBA Creative Concepts. The records required by 18 U.S.C. § 2257 and 28 C.F.R. Part 75 are kept by a non-employee third-party custodian and are available for inspection at:

10. Trademarks

"LesbianCash," "She Seduced Me," "SheSeducedMe.com," "Lesbian Sexuality," "LesbianSexuality.com" and our logos are our trademarks. You may not use them without our written permission, except as Part 3 allows for approved affiliates, and never in a way that is confusing or disparaging. Other marks belong to their owners.

11. Links

The Sites may link to third-party sites. We do not control those sites and are not responsible for their content, products or policies. You use them at your own risk and under their own terms.

12. No agency

Nothing in these Terms creates a partnership, joint venture, employment or agency relationship. Affiliates are independent contractors.

13. Disclaimers

THE SITES AND ALL CONTENT ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE FULLEST EXTENT THE LAW ALLOWS, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT PROMISE THAT THE SITES WILL BE UNINTERRUPTED OR ERROR-FREE. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.

14. Limit of liability

TO THE FULLEST EXTENT THE LAW ALLOWS, WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM IS LIMITED TO THE AMOUNT YOU PAID US IN THE 3 MONTHS BEFORE THE CLAIM AROSE. FOR AFFILIATES, IT IS LIMITED TO THE COMMISSIONS PAID TO YOU IN THAT PERIOD. SOME JURISDICTIONS DO NOT ALLOW THESE LIMITS, SO THEY MAY NOT APPLY TO YOU.

15. Indemnity

You agree to defend, indemnify and hold harmless LesbianCash and its owners, employees and contractors from claims, losses and costs (including reasonable legal fees) that arise from your breach of these Terms, your misuse of the Sites, or, for affiliates, your websites and marketing.

16. Force majeure

We are not responsible for delays or failures caused by events beyond our reasonable control. Examples include natural disasters, war, government action, power or internet outages, hosting or payment-processor failures, and cyberattacks.

17. Governing law and disputes

Law and venue. These Terms are governed by the laws of the State of California, without regard to conflict-of-law rules. Any court action allowed under these Terms will be brought in the state or federal courts located in Los Angeles County, California. Nothing here takes away mandatory consumer protections of the place where you live.

Informal resolution first. Before filing a claim, either party must try to resolve the dispute informally for 30 days by writing to the other party (see Section 18).

Arbitration. If informal resolution does not work, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association (AAA):

• Members: under the AAA Consumer Arbitration Rules.
• Affiliates: under the AAA Commercial Arbitration Rules.

Arbitration will be held in Los Angeles County, California, or by video or phone where the AAA rules allow. For members, a hearing may instead be held in the county where the member lives if the AAA Consumer Rules require it. Either party may seek an injunction in court to protect intellectual property.

No class actions. Claims may be brought only individually, not as a plaintiff or class member in any class, collective or representative action. The arbitrator may not combine claims of different people.

Small claims. Either party may bring an individual claim in small-claims court instead of arbitration, if the claim qualifies.

Member opt-out. Members may opt out of arbitration within 30 days of first agreeing to these Terms. To do so, email sheseducedmexxx@gmail.com with the subject "Arbitration opt-out" and include your name and member username or email. If you opt out, disputes go to the courts named above, and the class-action waiver still applies to the extent the law allows.

Jury waiver. To the extent the law allows, both parties waive trial by jury.

18. General

Notices. Send legal notices to sheseducedmexxx@gmail.com with the subject "Legal notice." Abuse reports, content complaints and removal requests go to the email address in Section 2. We may send notices to the email on your member or affiliate account.

These Terms, together with the Privacy Policy and the 2257 statement, are the entire agreement between you and us about the Sites. If any part is found unenforceable, the rest stays in effect. If we don't enforce a provision, we have not waived it. You may not assign these Terms. We may assign them to a successor business. Headings are for convenience only. Sections 7–18 survive termination, and so does our obligation to pay affiliates commissions they earned before termination but have not yet been paid, subject to these Terms.

Part 2: Members

19. Joining

To join, you complete the join form and pay through one of our payment processors, Epoch or SegPay. You must give true, current information. Your membership is personal and may not be shared, sold or transferred. Keep your login confidential, use a password you do not use anywhere else, and tell us right away if you think someone else has used it.

20. Billing

• Price and renewal. The price, billing period and renewal terms are shown on the join page before you pay.
• Automatic renewal. Unless the join page says otherwise, memberships renew automatically at the stated price and interval until you cancel. If an offer includes a trial or introductory price, the join page shows what it renews at and when.
• Who bills you. Charges are made by Epoch or SegPay and appear on your statement under their billing descriptor.
• Billing questions. If you think you were billed in error, contact the processor that billed you, or us, within 120 days of the charge so it can be investigated. This does not limit any rights you have with your card issuer under law.

21. Additional pre-selected memberships

Some join pages show an additional membership to another website that is already selected. The offer, its price and its renewal terms are shown next to the checkbox.

• If you leave it checked and complete your purchase, you are also buying that additional membership at the price shown. You also agree that we and the payment processor may share with that membership's seller the information needed to open your account (for example your name, email and username).
• If you uncheck it, you are not buying it, and nothing is shared.

Each additional membership is billed and canceled separately, through the payment processor that billed it (see Section 23).

22. Access

Your membership gives you access to the members area of the Site you joined for as long as your membership is active and paid. We may add, change or remove content and features at any time. We may limit excessive downloading or automated access.

23. Canceling

You can cancel at any time, online, through the processor that billed you:

Your purchase confirmation email from the processor also contains a cancellation link. We do not process cancellations directly. If you contact us, we will point you to the right processor link straight away.

Canceling stops future charges, and you keep access until the end of the period you've already paid for. Once access has started, payments are not refundable, except where the law or the processor's refund policy requires a refund.

24. Ending access

We may suspend or end a membership if a member breaks these Terms, gives false information, fails an age check, commits fraud, or files a chargeback for a valid charge. If we end a membership for reasons other than a breach, we will stop future charges. If we end your account, you may not rejoin without our permission.

Part 3: Affiliates

25. Account

To join the LesbianCash affiliate program, you sign up at https://lesbiancash.com/external.php?page=signup and agree to these Terms. We may accept or reject any application, and either side may end the relationship at any time. You must give accurate information and keep your login secure. We may put an account on hold if it has sent no sales or earned no commissions for 90 days.

26. Programs and commissions

• Revshare: up to 50% of the net amount of each join and rebill from members you refer, for as long as they stay members. "Net amount" means what the member paid, minus the payment processor's transaction fee for that charge. For example, on a $24.99 sale with a $2.99 processor fee, a 50% revshare pays $11.00.
• Webmaster referral: 10% of the commissions earned by webmasters you refer, for the life of their account.
• Other programs: pay-per-signup or other programs offered in writing or shown in the affiliate area.

No commission is earned on:

• fraudulent signups or traffic;
• your own or related-party purchases;
• incentivized traffic, unless we approved it in writing;
• traffic that breaks Section 30.

Refunds and chargebacks. We do not currently deduct ordinary member refunds from commissions you have earned, and we will give you advance notice before changing that. We may withhold or reverse commissions tied to fraud, to chargebacks from fraudulent signups, or to a breach of these Terms.

27. Payments

• When. We pay monthly, by Paxum or PayPal only, once your balance reaches the minimum payout of $100. Each pay period is one calendar month. Payments for each calendar month are processed beginning the 1st of the following month and sent by Paxum or PayPal, typically within 10 business days. Balances below the minimum carry over.
• Tax forms. Before your first payout, you must give us a valid IRS Form W-9 (US persons) or Form W-8BEN / W-8BEN-E (non-US persons). Payouts are held until we have it. We issue tax forms where the law requires and may apply backup withholding if required. You are responsible for your own taxes.
• Identity (KYC). We may require identity documents before paying, to comply with "know your customer" and anti-fraud rules.
• Holds. We may hold amounts for up to 90 days while we review suspected fraud or chargebacks from fraudulent signups. After an account closes, we pay the undisputed balance within 90 days. We may permanently withhold commissions tied to fraud or to a breach of these Terms.
• Payment details. You are responsible for your payout provider's fees and for keeping your payment details correct.

28. Rate changes

We may change commission rates or programs by giving notice by email or in the affiliate area. Changes apply only to sales made after they take effect, never retroactively. We may correct reporting errors.

29. Creative

Use only the banners, links, text, photos and videos we provide in the affiliate area, unless we approve other material in writing. Do not alter our material in a way that changes who or what it shows. If you display explicit promo material, link to our 2257 statement at https://lesbiancash.com/external.php?page=2257 (Section 9). If we ask you to replace or remove any creative, you must do so within 48 hours.

30. Promotion rules

Allowed: ordinary SEO on your own original content (reviews, articles, galleries), including truthful use of the site names, and promoting LesbianCash-issued promo links and codes.

Not allowed:

• Spam. No unsolicited email, text messages or social-media DMs.
• Email rules. Any email you send that promotes the Sites must:
  • be approved by us in writing first;
  • go only to people who opted in;
  • fully comply with the CAN-SPAM Act and FTC rules (16 C.F.R. Part 316). That means truthful headers and subject lines, the "SEXUALLY-EXPLICIT:" subject label and initial-view rules for sexually oriented email, a valid postal address, and an opt-out that is honored within 10 business days.
  • On request, you must give us your consent records and suppression list.
• Disclosure. You must clearly and conspicuously disclose that you earn commissions, as the FTC Endorsement Guides (16 C.F.R. Part 255) require. For example, put "I earn a commission if you join through my links" near the link or review. No fake reviews, and no false claims about price, "free" access or cancellation.
• Brand bidding. No bidding on or buying the site names, or misspellings of them, as search keywords. That includes terms like "SheSeducedMe coupon," "LesbianSexuality discount" or "LesbianCash code."
• Codes. No coupon or discount codes we did not issue.
• Domains and URLs. You may not register or use any domain, subdomain, or social handle that contains, imitates, or is confusingly similar to our site names or trademarks (for example "sheseducedme-free.com"). Pages on your own domain whose URL path names our sites (such as yoursite.com/review/she-seduced-me) are permitted.
• Copying our sites. No framing our pages, copying our look and feel, or implying that your site is ours.
• Bad software. No spyware, adware, pop-overs or pop-unders, forced redirects or bots.
• Fake pages. No fake blogs, fake "password" or "free login" pages, or "leaked" content claims.
• Cookie stuffing or any other false attribution.
• Incentives. No cash-back, rewards or other incentives to join without our written OK.
• Prohibited themes. No marketing (keywords, titles, tags, ad copy, landing pages) that states or implies:
  • that anyone is under 18, such as "teen," "young girl," "schoolgirl" or "barely legal" used to suggest minors;
  • incest presented as real;
  • non-consent, force, intoxication or incapacity;
  • hidden-camera or "real" non-staged content.
• Minors. No targeting minors or advertising on sites or channels aimed at minors.

If you break these rules, we may close your account immediately and keep commissions earned from the non-compliant traffic. You are responsible for following the laws that apply to your own sites, including age-verification laws.

31. Reports

You can see your traffic, sales and commission reports in the affiliate area. Our reports are the basis for payment. If you think a report is wrong, tell us within 60 days so we can review it. Program details not shown publicly, such as your individual rates and stats, are confidential.
